There are various types of brain injury, caused by a variety of factors, including brain injury that occurs prior to birth (prenatal) or during birth, and acquired brain injury which occurs after birth due to outside causes, which may be non-traumatic brain injury or traumatic brain injury.
As a result of insufficient oxygen to the baby’s brain due to premature separation of the placenta, umbilical cord prolapse, prolonged labor or contractions that are too strong, brain damage often occurs during birth. Failure to diagnose the need for a Caesarian or delay in performing one can result in this type of brain damage.
Non-traumatic brain injury is caused by outside factors such as a stroke, brain tumors, infection, poisoning, lack of oxygen in the blood (hypoxia) or a shortage of blood supply (ischemia). Incorrect diagnosis, wrong medical treatment, failure to diagnose and any number of other medical factors may contribute to such outside factors, resulting in brain injury.
Traumatic brain injury is a specific type of injury that involves an impact such as a blow to the head or violent movement that jars the brain. Any powerful motion that results in the brain crushing against the skull can bruise or tear brain tissue and causes bleeding, which can further damage the brain by building up pressure.
Car accidents, firearms and falls (in that order) are the leading causes of traumatic brain injury.
With traumatic brain injury an MRI or CT scan may not detect the brain damage that occurred. The only clues may be symptoms the person experiences after the injury.
Symptoms or disabilities may result from TBI and include diminishing capabilities in the following areas:
Cerebral palsy and other brain damage that occurs at birth may not readily be observable and only noticed by parents later on when the child is not developing normally.
Any of the types of brain injury listed above may be caused through the fault of another, whether as a result of negligence, a wrongful act or medical malpractice. If you believe that you or a loved one may have suffered serious brain injury caused by someone else, the Law Offices of Morgan Adams have injury lawyers ready to help evaluate your situation. Call our law firm at (423) 265-2020 or (866) 580-4878, or click here to email us.The following is a list of lawyers throughout the country who have undertaken advanced studies in the recognition, presentation, and litigation (if necessary) of various traumatic brain injuries to include: mild traumatic brain injury, acquired brain injury, brain injury, seizure disorders, concussions and the sequelae (conditions which result) from these disorders. These include but are not limited to neurological deficits, cognitive deficits, behavioral changes and psychological difficulties. In many cases there are overlaps between these problems. The challenge is always to determine which deficits are related to head trauma and which are related to other causes.
In the case of each of the individuals mentioned below, there has been a demonstrated level of competence such that I feel comfortable listing the individual as a lawyer you should strongly consider using for a loved one suffering from a traumatic brain injury. My firm has no fee arrangement with these lawyers. They are listed because I think these are good lawyers, who know this area of the law as well, or better, than anyone else in their respective states, with extensive specialized continuing legal education on handling traumatic brain injuries. If you do decide to use one of these lawyers please feel free to say you saw their name on my website and feel free to mention my name, Morgan Adams from Tennessee, to explain your contact. Should you wish, our firm does travel throughout the country assisting other lawyers in handling significant cases. Finally, until you have signed a written fee agreement with The Law Offices of Morgan Adams, we assume no responsibility for your representation.
